The High Court has awarded Range Resources Drilling Services Ltd $1,247,847.46 in a breach of contract case against 360 Oil and Gas Limited, in a judgment that included damages and interest.
The decision was delivered in the San Fernando High Court, Sub Registry, with Robin B Ramoutar appearing for the claimant and Raegel Jagroop appearing for the defendant.
The case arose from a workover service contract dated January 31, 2019, which the claimant said was duly executed between the parties for the provision of manpower and equipment to carry out works on the defendant’s equipment.
Range Resources Drilling Services Limited alleged that it completed the contracted works and submitted invoices for payment, which were not honoured by the defendant.
The defendant accepted that a contract existed but denied that the work was carried out as claimed and also alleged that no invoices were received.
During cross-examination, however, the defendant’s position shifted, with its witness admitting that some invoices had been received. The defendant also maintained that not all of the work claimed was completed, a position which differed from its pleaded defence.
The court heard that the invoices submitted by the claimant were signed by employees of the defendant. It was also submitted that the invoices were consistently signed by the same employee across the documents.
The court found that the defendant’s evidence materially departed from its pleaded case, particularly in relation to receipt of invoices and the performance of work under the contract.
It further accepted that the defendant had received the invoices and had not made payment for the sums due under the agreement.
Judgment was therefore entered in favour of Range Resources Drilling Services Limited in the sum of $1,247,847.46, inclusive of damages and interest.
